What is the We4U app?
The We4U app helps clients and their network to better organize help and support in daily life. For example, for activities, contact moments, or practical help. The app may consist of a user environment, an administrator environment, and other components made available by We4U app B.V.
In these terms, we mean by:
you: the user of the organization account;
we/us: We4U app B.V.;
organization: the organization you work for;
in writing: also by email.
When do these terms apply?
These terms apply to all organization accounts of the We4U app. We may adjust these terms. If we do so, we will let you know. Is a part of these terms invalid? Then the other agreements remain in force.
Use of the We4U app
We do our best to ensure the We4U app works properly and safely. We may modify, improve, or expand the app. Sometimes functions may change or disappear. We offer support for technical issues via support@we4u.app. We determine ourselves how we provide support. We make daily backups of data in the app.
You get access to the We4U app and any administrator environment through your organization.
You only use an account that is in your name. You may not let others use your account or login details.
We may perform checks on the use of the app, such as checks on log
and user data. If necessary, we may conduct further investigation into the
use of the app.
You and your organization always remain responsible yourself for:
the use of the app;
the data you share;
the way the app is used within the organization;
decisions made as a result of using the app;
proper instruction to employees;
and a careful implementation of the app within the organization.
You will inform the people you invite to use the We4U app yourself about:
the use of the app;
the terms of use;
and the own responsibilities of users and their network.
We cannot guarantee that someone will respond to a request for help or actually provide help. We are also not responsible for agreements or contact between users outside the app.
Careful handling of data
The app may contain information about clients and their network. You will handle this carefully and confidentially, just like other client information within your work.
The We4U app is not intended for sharing medical data or other sensitive personal data with the clients' network, unless this is necessary and permitted by law.
Only share data of others if this fits within your work and is permitted according to the rules of your organization and the law.
The organization remains responsible itself for processing personal data of the people you invite to the We4U app and users within its own organization.
What is not allowed?
You may not use the app:
in violation of the law;
in violation of internal rules or confidentiality obligations;
to mislead others;
to harass others;
to view or share data without authorization;
to send spam or unsolicited messages;
to use other people's accounts;
to bypass app security;
or in a way that causes damage or risk to others or to the app.
You are responsible yourself for the messages, photos, tasks, and other information you share through the app.
The information and content you share through the app remain the property of your organization or the right holder. By placing this information in the app, you give us limited permission to use it for the functioning of the app.
Maintenance and availability
We may temporarily stop or limit the app if necessary for:
maintenance;
security;
technical adjustments;
or improvements to the app.
We cannot promise that the app will always work without disruptions or will always be available.
The We4U app is not an emergency service or rescue service for emergencies. In an emergency, always call 112 or another appropriate emergency service.
Privacy and confidentiality
We handle personal data and other data processed through the app with care. In our privacy statement, we explain how we do this. We do not sell personal data to other parties.
We will continue to handle data confidentially, even after an account has been terminated.
If we are required to share data because the law or a judge obliges us to do so, we are not liable for this.
Blocking or terminating an account
We may temporarily block or terminate an account if:
these terms are violated;
there is abuse;
or the use poses risks or damage to others.
We may also remove messages, photos, or other content if they:
violate the law;
violate these terms;
are harmful;
or pose risks to users or others.
Ownership of the app
All rights to the We4U app, the software, texts, images, and design remain ours or our partners'. You only get the right to use the app normally according to these terms. You may not copy, sell, modify, or use the app or parts thereof in any other way outside of the normal use of the app.
Liability
You use the We4U app at your own responsibility. We are not liable for damage resulting from:
the use of the app;
decisions made based on information from the app;
the help requested, offered, or received through the app;
actions of users or others;
or temporary disruptions or errors in the app.
We are also not liable for indirect damage, such as lost income, damage to reputation, or loss of data. We are only liable if the damage is caused by intent or a serious mistake on our part.
If we are liable, our liability is limited to the amount that the organization paid for the use of the app in the twelve months prior to the damage. If the law determines otherwise, the law applies.
Which law applies?
Dutch law applies to these terms. Disputes will be submitted to the competent court in the Netherlands, unless the law determines otherwise.
